Kagadi Seventh Day Adventist Church has won a land case against Joseph Kasumba a resident of Kagadi town council, who was claiming ownership of the three hectare contested land.
Kagadi SDA church was jointly sued with Kibaale district land board in the civil suit no.12 of 2022.
In the case, Kasumba had claimed ownership of the contested land, alleging that he had lawfully purchased the land from the individual owners, including Moses Tusubira and Bakiite Leonard.
He claimed that this land had been fraudulently included within the Kagadi SAD Church land title Buyaga Block 32,plot 6,Measuring approximately 8.679 hectares, located in Kagadi North Lc1,Kagadi town council.
Kasumba had asked court to cancel the said title and be declared the lawful owner of the three hectare contested land.
However during the ruling in Hoima high court on Friday 17th January, 2025, Justice Byaruhanga Jesse Rugyema ruled that Kagadi SDA church was the lawful proprietor of the land and acquired it through legal procedures.
The plaintiff Joseph Kasumba has been ordered to pay the church Shillings 15Million for the disturbances he caused through wrongful claims.
Speaking to Paradigm FM, after the court ruling, Pastor Johnson Byabasaija Muluuri of the Kagadi SDA Church thanked God for enabling them to win the land case, adding that this is a huge relief to the church which intends to set up development projects on the land.
He has asked the plaintiff to welcome the judgment in good faith and embrace reconciliation for a peaceful coexistence.
